By booking a charter or accessing our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.

2. Service Overview

CommonsClearanceHub offers luxury yacht charter services, which include but are not limited to:

  • Daily yacht rentals
  • Sunset cruises
  • Corporate retreats
  • Private events
  • Multi-day charters

We may alter or cease services without prior notice, subject to availability and weather conditions.

3. Booking and Reservations

3.1 Booking Process

When making a reservation, you must:

  • Be at least 18 years old
  • Provide accurate and comprehensive information
  • Remit the necessary deposit as mentioned in your booking confirmation
  • Concede to these Terms & Conditions

3.2 Confirmation

We will confirm your booking once the payment is received and provide you with written confirmation. We have the right to deny service to anyone at our discretion.

3.3 Availability

The availability of charters is reliant on the appropriate vessel availability and favorable weather conditions. We aim to accommodate your requested dates and times to the best of our abilities.

4. Payment Terms

4.1 Pricing

All of our prices are quoted in € and they include all applicable taxes, unless specified otherwise. Prices may change without prior notification.

4.2 Payment Schedule

  • Deposit: 50% of the full charter fee, payable at time of reservation
  • Balance: Due 48 hours before the departure of the charter
  • Any additional charges (if applicable): Payable at the end of the charter

4.3 Payment Methods

Accepted methods of payment include most major credit cards, bank transfers, and certified cheques. We process payments through a secure, encrypted system.

5. Cancellation and Refund Policy

5.1 Customer Cancellations

  • More than 72 hours before departure: Full refund minus any processing fees
  • Between 24 and 72 hours before departure: Refund of 50%
  • Less than 24 hours before departure: No refund available

5.2 Weather Cancellations

Should the captain deem weather conditions unsafe, we will:

  • Reschedule your charter to another available date at no extra cost
  • Issue a full refund if rescheduling is not possible

5.3 Mechanical Issues

In the chance a mechanical issue arises with the designated vessel, we will try to arrange an equivalent alternative. If that is not possible, we will provide a full refund.

6. Safety and Conduct

6.1 Safety Requirements

All aboard are expected to:

  • Adhere to all instructions given by the crew
  • Utilize any provided safety equipment when needed
  • Declare any health conditions that may affect their safety on board
  • Stay within the designated areas on the vessel

6.2 Prohibited Items

The following items are not permitted on board:

  • Glass containers
  • Illegal substances
  • Firearms or weapons
  • Excessive consumption items (beyond reasonable amount)
  • Pets, except if they are pre-approved

6.3 Conduct

Passengers must behave respectfully. We reserve the right to end a charter early without a refund if the conduct of a passenger poses a safety risk or disturbs others.

7. Liability and Insurance

7.1 Our Liability

We limit our liability to the cost of your charter and do not take responsibility for:

  • Injuries caused by passenger negligence
  • Loss or damage of personal belongings
  • Indirect, consequential, or punitive damages
  • Delays attributed to weather or conditions outside our control

7.2 Insurance Coverage

We maintain comprehensive marine insurance for our vessels and business operations. Passengers should have their own travel and personal insurance coverage.

7.3 Assumption of Risk

By participating in our services, you recognize the inherent risks associated with marine activities and take responsibility for your own safety and security.

8. Modifications and Itinerary Changes

We reserve the right to adjust itineraries, paths, or timetables depending on weather, safety, or operational needs. We will endeavor to offer comparable alternatives where feasible.

9. Force Majeure

Events beyond our control, such as severe weather events, natural disasters, government orders, port shutdowns, or mechanical failures, do not hold us accountable for any delays, cancellations, or alterations.

10. Privacy and Data Protection

Your personal data is processed in line with our Privacy Policy. Your use of our services constitutes an agreement to our information collection and usage as outlined in the policy.

11. Intellectual Property

The content on our website, including but not limited to text, graphics, logos, and images, is shielded by copyright and trademark laws. Unapproved reproduction, distribution, or creation of derivative works is prohibited.

12. Governing Law

The applicable laws within Germany govern these Terms. Legal disputes shall be resolved in the courts located in Hamburg, Germany.
